In these Terms, "we", "us" and "our" mean The Bear Group Ltd. "You" means the person visiting or using the website.

These Terms apply to the websites we operate, including dirkbauer.com, waranyachamrat.com, zolanius.com and thebear.group (together, the "websites").

2. Accepting these Terms

By visiting or using the websites, you agree to these Terms. If you do not agree, please do not use the websites.

3. What the websites are for

The websites exist to share writing and information, let you subscribe to our newsletter, and let you get in touch with us. They are informational. Using them does not create any professional, advisory or client relationship with us. Any professional engagement, including a Zolanius assessment or advisory work, starts only under a separate written agreement signed by both sides.

4. Not professional advice

The content on the websites is general information and personal opinion. It is not legal, financial, tax, investment or engineering advice for your situation, and you should not rely on it as such. Please read our Disclosure section as well. If you need advice for your own circumstances, speak to a qualified professional.

5. Intellectual property

The content on the websites, including text, writing, layout, graphics and logos, is owned by us, our founders, or our licensors, and is protected by copyright and other laws. Names and marks such as Zolanius and Core and Bloat are ours.

You may view and read the content for your own personal, non-commercial use. You may share links to our pages. You may not copy, republish, sell, or create derivative works from our content without our written permission.

All content on this site, including the Core and Bloat™ name and mark, is owned by The Bear Group Ltd or used under license. You may not use the Core and Bloat name or mark without prior written permission.

6. How you may use the websites

You agree not to:

  • use the websites for anything unlawful, or in a way that breaks any applicable law
  • copy, scrape or harvest content or data by automated means beyond normal search-engine indexing
  • try to gain unauthorised access to the websites, their servers, or any connected systems
  • interfere with the normal operation or security of the websites
  • misrepresent who you are, or submit content you do not have the right to submit

If you send us content through a form or by email, you confirm you have the right to do so, and you give us permission to use it for the purpose you sent it.

7. Newsletter

Subscribing to our newsletter is optional and based on your consent. You can unsubscribe at any time using the link in any email. How we handle your details is explained in our Privacy Policy.

8. Links to other websites

The websites may link to sites we do not control. We provide those links for convenience. We are not responsible for the content, accuracy or practices of any third-party site, and a link is not an endorsement.

9. No warranty

The websites and their content are provided "as is" and "as available". We do our best to keep them accurate and running, but we do not guarantee that the content is complete or error-free, or that the websites will always be available or free of faults.

10. Limitation of liability

To the fullest extent allowed by law, we are not liable for any indirect, incidental or consequential loss arising from your use of, or inability to use, the websites, or from reliance on their content. Nothing in these Terms limits any liability that cannot be limited by law.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Continuing to use the websites after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have jurisdiction over any dispute. If you are a consumer in the European Union or the United Kingdom, this does not remove any mandatory rights you have under the law of your home country.

Privacy Policy

This policy explains what personal data we collect on our websites, why we collect it, and the rights you have over it. We have written it in plain language on purpose.

1. Who is responsible for your data

The websites are operated by The Bear Group Ltd, and we are the data controller.

This policy covers the websites we operate, including dirkbauer.com, waranyachamrat.com, zolanius.com and thebear.group.

2. What we collect

When you subscribe to our newsletter. Your email address, and your name if you choose to give it.

When you contact us through a form or by email. Your name, email address, and whatever you write in your message.

When you book a call with us (if this feature is enabled on the site). Your name, email address, and the scheduling details for the meeting.

When you simply browse (analytics). We use Google Analytics 4 to understand how people use the websites. It collects information such as the pages you view, how you arrived, your approximate location based on your IP address, your device and browser type, and how you interact with pages. This runs only after you accept analytics cookies (see section 4).

Automatically, for security and operation (server logs). Our host records standard technical information such as IP address, timestamps and browser type, to keep the websites running and secure.

We do not ask for or intentionally collect sensitive personal data on the websites.

3. Why we use your data, and our legal basis

For visitors in the EU, EEA and UK, we rely on the following legal bases under the GDPR: sending you the newsletter on the basis of your consent; running analytics on the basis of your consent; responding to your enquiry on the basis of legitimate interests, or steps before entering an agreement; keeping the websites secure and working on the basis of legitimate interests; and meeting legal obligations where the law requires it.

Where we rely on your consent, you can withdraw it at any time. Withdrawing consent does not affect anything we did before you withdrew it.

4. Cookies and consent

On thebear.group specifically, we set no cookies and run no analytics, so no consent banner appears on this site. The rest of this section describes cookies across the group's websites generally, which applies to our properties that do use analytics.

Cookies and similar technologies are small files stored on your device. We group them into essential cookies, needed for the website to work, which are always on; and analytics cookies, used by Google Analytics 4 to measure usage.

We use the Silktide Consent Manager to ask for your choice. Non-essential cookies, including Google Analytics, load only after you accept them through the banner. We use Google Consent Mode v2, which keeps analytics from running until you consent.

You can change or withdraw your choice at any time by reopening the cookie preferences from the banner. The banner also shows the specific cookies in use.

5. Analytics in more detail

Google Analytics 4 is provided by Google. When it is active, Google processes the data described above on our behalf, and data may be processed on servers outside your country, including in the United States. Google's own privacy information is at https://policies.google.com/privacy. You can prevent analytics by rejecting analytics cookies in our banner, or by using Google's browser opt-out add-on. We keep Google Analytics data for 14 months.

6. Who we share your data with

We do not sell your personal data. We share it only with the service providers we use to run the websites, and only so they can perform their service for us. These may include Hostinger for website hosting, Google for analytics, Beehiiv for newsletter delivery, Attio for contact and customer records, Resend for contact form email delivery, Google Workspace for business email, and Fantastical Openings for meeting scheduling. We may also disclose data if the law requires it, or to protect our rights.

7. Sending data outside your country

We are based in Hong Kong, and some of our providers are in other countries, including the United States and within the EU. When we transfer personal data across borders, we rely on appropriate safeguards where required, such as the EU Standard Contractual Clauses or the EU-US Data Privacy Framework.

8. How long we keep your data

Newsletter: until you unsubscribe, after which we remove you from the active list within a reasonable period. Contact enquiries: while we handle your enquiry and for a reasonable period afterwards, up to 24 months, then we delete them. Analytics: for the period set in Google Analytics (see section 5). Server logs: for up to 30 days, for security and troubleshooting.

9. Your rights

If you are in the EU, EEA or UK, you have the right to access your data, correct it, delete it, restrict or object to how we use it, receive a copy in a portable format, and withdraw consent. You also have the right to complain to your local data protection authority (in the UK, the ICO).

If you are in Hong Kong, you have the right under the Personal Data (Privacy) Ordinance to access and correct the personal data we hold about you.

If you are in California, you have the right to know what personal information we collect, to request deletion, and not to be discriminated against for exercising your rights. We do not sell your personal information.

10. Children

The websites are meant for adults and are not directed to children. We do not knowingly collect data from anyone under 16. If you believe a child has given us data, contact us and we will remove it.

11. Security

We take reasonable technical and organisational steps to protect your data. No method of transmission or storage is completely secure, so we cannot promise absolute security.

12. Changes to this policy

We may update this policy from time to time. When we do, we will change the "Last updated" date above. If the change is significant, we will make that clear on the websites.

Independence of Zolanius

The Bear Group Ltd operates Zolanius, an independent product and technology due-diligence practice for early-stage investors. The founders' personal fractional CTO and advisory work, described on dirkbauer.com and waranyachamrat.com, is separate from Zolanius. To protect the independence of Zolanius, that practice does not accept assessments of companies where either founder has performed fractional, advisory, or consulting work in the previous six months. Where a founder has already advised a company, and an investor later commissions a Zolanius assessment of it, Zolanius recuses.

Accessibility

We are committed to making thebear.group accessible to everyone, including users of assistive technologies. The site targets WCAG 2.1 Level AA conformance. Text and interactive elements use a minimum contrast of 4.5:1 against their background. Interactive controls are keyboard-operable and expose accessible names. Content structure uses semantic landmarks and a single h1 per page. Font sizing uses relative units and reflows without loss of content down to a 320px viewport. Content images carry descriptive alt text, and decorative images are marked as such.
